Had a bad car wreck in Mathews County? Let our experienced lawyers help

Mathews County is one of Virginia’s smaller counties, with only about 9,000 residents. It is also one of three counties in our Commonwealth without traffic lights (Charlotte and Bath are the other two). This, combined with the fact that tourism is a major industry for the area, makes Mathews County a common “stop” for traffic accidents.

Although Mathews County doesn’t have the major interstates and traffic congestion of urban localities, we still see many bad wrecks. A car crash—even on a rural road and at low speeds—can still result in serious injuries. If you or a family member has been injured in a collision, contact an experienced Mathews County accident lawyer.

At GibsonSingleton Virginia Injury Attorneys, we consider it our calling to get injured victims the compensation they need to recover. When you put your trust in us, you don’t pay anything unless we win—we call it our Zero Fee Guarantee.

What are the current insurance requirements in Mathews County?

While Virginia doesn’t require drivers to carry auto insurance (instead, they can pay a $500 opt-out fee to the DMV), it does have minimum coverage for those who choose to be insured. Those minimums are:

  • $25,000 injury liability per person per accident
  • $50,000 total injury liability per accident
  • $20,000 property damage liability per accident

Because automobile insurance isn’t required in Virginia, insured drivers are required to carry uninsured/underinsured motorist coverage. The minimums for uninsured/underinsured coverage must match the minimums of your liability coverage.

However, the problem with these minimums is that they rarely cover the true costs of an injury. For example, surgical treatment for a broken leg typically costs $17,000 to $35,000 or more. If you suffer more than one injury or your passengers are injured, the cost would almost certainly be more than the “total injury liability” minimum of $50,000. In such a case, you would need to sue the at-fault driver to recover the difference between his policy’s minimum and the actual cost of your injuries.

What are frequent injuries that result from car accidents?

Car accidents can lead to a wide range of injuries, each presenting unique challenges for victims. Whiplash and nerve damage often take longer to detect than other types of injuries, but they can both cause chronic pain and reduced mobility.

Broken bones and fractures may impact the hip, back, arms, legs, and other body parts. These injuries may prevent you from returning to work for a considerable amount of time because you require extensive medical treatment and rehabilitation.

Amputations have a devastating impact on a person’s life. These injuries may prevent you from resuming your career, and the adjustment to the loss of a body part can include the use of prosthetics and severe emotional turmoil.

Internal organ damage can be life-threatening, and it requires immediate medical attention. Traumatic brain injuries (TBI) may result in serious cognitive impairments, affecting memory, concentration, and even personality. Spinal cord injuries can lead to full or partial paralysis, drastically altering your ability to perform daily tasks, and it may necessitate the use of mobility devices and lifelong assisted living care.

Severe burns cause intense physical pain and emotional trauma, impacting a person’s self-image and mental health. It’s important to mention the significant financial strain resulting from ongoing medical treatments, rehabilitation, and potential loss of income from the inability to work.

Who is liable for injuries caused by car accidents in Mathews County?

Negligent drivers are often the primary focus when determining liability in car accident cases. Drivers can be liable when careless behaviors such as distracted driving, speeding, tailgating, or DUI contribute to an accident. But liability doesn’t always stop with the person behind the wheel.

Trucking and delivery companies may be liable if they fail to ensure regular vehicle maintenance and inspections. Inadequate training can also lead to accidents, further placing responsibility on employers for not adhering to safety standards. In fact, employer negligence during the hiring process can significantly affect car accident claims with commercial drivers. Companies are responsible for ensuring their employees are qualified and trained to safely operate vehicles. So, failing to conduct thorough background checks—or ignoring red flags such as past driving violations—increases the risk of devastating accidents.

Defective automobile components can also contribute to car accidents, making manufacturers liable for injuries. These defects might include malfunctioning brakes, faulty airbags, or issues with steering systems, which can all compromise a vehicle’s safety.

It’s clear that proving liability in these cases requires a detailed investigation, including a review of product recalls, technical inspections, and expert analysis. We can help.

How can your Mathews County car accident attorney help?

Your lawyer will build a case by thoroughly investigating the accident. This process begins with collecting essential evidence, such as police reports, photographs, and eyewitness interviews. Medical records will also be scrutinized so your attorney can understand the full extent of your injuries.

Dashcam or surveillance camera footage can offer powerful insights into the events leading up to the collision. Further, expert testimonies can strengthen the case by providing professional perspectives on technical issues or the severity of injuries. For example, accident reconstruction experts may be used to provide a detailed analysis of how the accident occurred. They can use simulations and models to clarify complex scenarios.

GibsonSingleton Virginia Injury Attorneys will negotiate with the negligent party’s insurance company, seeking a settlement that compensates you for your injuries, medical expenses, lost wages, pain and suffering, and other related costs. If the other side makes an insufficient settlement offer, our lawyers are always prepared to handle your case in court.

Can our lawyers help you get just compensation after a Mathews County auto accident?

When another person caused the car or truck collision that injured you, you probably expect that the person (and his or her insurance company) will give you the money you need to recover fully. But as experienced Mathews County car accident attorneys, we can tell you this is not always the case. Few people are willing to openly admit they’re wrong on the best of days, and the same is true after a car wreck.

You also can’t count on an insurance company to offer you fair compensation for your losses either. Big insurance companies profit by offering the smallest compensation possible, regardless of your situation or how much money you need to recover.

As lawyers who live and work in Virginia, we know how to help you. John has previously worked for big insurance companies, while Ken has tried hundreds of cases at the state and federal levels. We’re more than familiar with the tactics big insurance companies use. And as former United States Marines, we’re not afraid to tackle a challenge.

We will see that you get fair compensation for your losses, or we won’t get paid. Call our attorneys at (804) 413-6777 or toll-free at (855) 781-6777 today for a free consultation.
