What are the insurance requirements in effect in Mathews County?

While Virginia doesn’t require drivers to carry auto insurance (instead, they can pay a $500 opt-out fee to the DMV), it does have minimum amounts of coverage for those who choose to be insured. Those minimums are:

  • $25,000 injury liability per person, per accident
  • $50,000 total injury liability per accident
  • $20,000 property damage liability per accident

Because automobile insurance isn’t required in Virginia, the state does require insured drivers to carry uninsured/underinsured motorist coverage. The minimums for uninsured/underinsured coverage must match the minimums of your liability coverage.

The problem with these minimums is that they rarely cover the true costs of an injury. For example, surgical treatment for a broken leg typically costs $17,000 to $35,000 or more. If you suffer more than one injury, or if your passengers are injured, the cost would almost certainly be more than the "total injury liability" minimum of $50,000. In such a case, you would need to sue the at-fault driver to recover the difference between his policy’s minimum and the actual cost of your injuries.
